Terms and Conditions

Below, you can find the Terms and Conditions under which Memory Lane Audiobooks Ltd. (Memory Lane Audio) provides you, whether you are the person buying the audio memoirs package or a speaker recording the audio memoirs package, with our Goods and Services. Once you've received your order confirmation from us, you will be deemed to have accepted our Terms & Conditions as set out below.

Before you order a product from us, please make sure you read, understand and are happy with these Terms & Conditions. Thank you.

1. General Terms and Conditions
 

1.1. These Terms & Conditions apply to the purchase of the Audio Memoirs by you (the “Customer” or “You” – the person(s) purchasing the Audio Memoirs) and to you if you are a “Speaker” (the person recording the Audio Memoirs).
 

1.2. We are “Memory Lane Audiobooks Ltd.” (or the “Supplier” or “Us” “We”).
 

1.3. These are the terms on which we sell all our Audio Memoirs packages to you. If you purchase any of our Audio Memoirs packages, you thereby agree to be bound by these Terms & Conditions. We can only sell our Audio Memoirs packages to You if You are eligible to enter into a contract and are at least 18 years of age.
 

1.4. To produce the chosen Audio Memoirs package, You agree that the Speaker has permission to direct and dictate their Audio Memoirs to us (if You are not the Speaker yourself).
 

2. Interpretation
 

2.1 “Audio” or “Audio Memoirs” means the final recordings that have been produced by Memory Lane Audiobooks Ltd. involving the Customer’s and/or Speaker’s participation.
 

2.2 “Content” means spoken memoirs and/or music clips supplied by the Customer or Speaker or by Memory Lane Audiobooks Ltd.
 

2.3 “Contract” means this legally-binding Terms & Conditions agreement between You and Us for the production and delivery of Audio Memoirs;
 

2.4 “Speaker” means the person narrating the Audio Memoirs; the Speaker is the main source of Content usually through in-person interviews with an interviewer from Memory Lane Audiobooks Ltd.;
 

2.5 “Website” means our website www.memorylaneaudio.com and any other related domains on which the Audio Memoirs are advertised or through which the Services are supplied.
 

3. Goods & Services and Process
 

3.1 The type of Audio Memoirs package You have ordered will be set out in an email confirmation following your order, and is personal to You or your loved one.
 

3.2 If You change your mind leading to substantially more work, we will provide you with a quote to account for this additional work.
 

3.3 We will make any edits or changes you require to your first draft, providing these are supplied in writing. If, after this, you would like any further changes to be made, we can provide you with a quote for this additional editing time.
 

3.4 We will correct any technical errors, should You find any, providing these are pointed out in writing before You sign off on your final edited recordings.
 

3.5 Please note that we will do all we can to ensure your final Audio Memoirs are flawless, but occasionally there may be an error we're unable to fix. Ultimately, it will be your responsibility to sign off the work done for you.
 

3.6 If you are unhappy with any form of the process, You will inform us immediately. We will be given the time and opportunity to rectify any mistakes or make any desired changes in order to resolve any valid complaints.
 

3.8 All of our Audio Memoirs packages which appear on our Website are subject to availability and to change.
 

4. Personal Information
 

4.1 Any information retained and used by Memory Lane Audiobooks Ltd. falls under our Privacy Policy.
 

4.2 You expressly agree that we can contact you using e-mail or other electronic communication methods, by post and by phone. We will try to stick to your preferred mode of communication.
 

4.3 In certain instances we ask our Speakers for permission to use Content for promotional purposes. We will not upload or publish any of your content unless you provide us with your written permission.
 

5. Copyright & Confidentiality
 

5.1 The Speaker and Customer agree that the copyright of any Content is automatically passed on to the Speaker and Memory Lane Audiobooks Ltd.
 

5.2 The Speaker has the right to share the Audio with friends, family members and colleagues. The Speaker is liable for any damages as a result of complaints made about the Content by third-parties including defamation charges.
 

5.3 Audio Memoirs are not produced for publishing to the general public. Unless otherwise agreed in writing, Audio Memoirs are private and confidential.
 

5.4 The Speaker and Memory Lane Audiobooks Ltd. share the copyright of the Audio Memoirs and any draft versions. This means Memory Lane Audiobooks Ltd. cannot publish the Audio or any part of it, without the permission of the Speaker; and vice versa.
 

5.5 If the Speaker asks permission to publish any Content and this is granted by Memory Lane Audiobooks Ltd., the Storyteller assumes full responsibility for the publication and any damages resulting from that publication, even if the publication is facilitated or executed by Memory Lane Audiobooks Ltd.
 

6. Basis of Sale
 

6.1 The Order process is set out by email. It is your responsibility to check that you have used the ordering process correctly.
 

6.2 A Contract will be formed for the Goods and Services ordered only when you receive an email from us confirming the Order. You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving you confirmation of the Contract by means of an email with all information in it.
 

6.3 Any quotation is valid for a maximum period of 14 days from its date, unless we expressly withdraw it at an earlier time.
 

6.4 No variation of the Contract, whether about description of the Goods and Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and Memory Lane Audiobooks Ltd. in writing.


7. Price & Payments
 

7.1 Any add-on services will need to be paid before we can proceed with the process.
 

7.2 Any invoice relating to these services we send to you is due for payment within 7 days.
 

7.3 We reserve the right to suspend all work on your project if any payment is overdue.
 

8. Risk and Title
 

8.1 Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.
 

9. Excluding Liability
 

9.1 Memory Lane Audiobooks Ltd. will not be liable for any loss of profits, economic loss, or indirect or consequential loss of any kind arising out of or in connection with the Project.
 

9.2 The total aggregate liability of Memory Lane Audiobooks Ltd., whether in contract or tort, to Customer and Speaker under or in connection with the Order or any actions or inactions of Memory Lane Audiobooks Ltd. and/or its Associates and/or freelancers providing services on its behalf will not exceed in aggregate the total fee paid for the accepted Order.
 

10. Withdrawal, Cancellation and Refunds
 

10.1 You can cancel the Order by sending an email to amy@memorylaneaudio.com with the title “Order Cancellation”.
 

10.2 Up to 14 days after receipt of your Order Confirmation, you may claim a full refund.
 

10.3 Our Goods & Services are personalised. Therefore, once the interviewer who provides a service directly related to your project has commenced work, your ability to request a refund is limited and payment will still be due to us, as per the Order Confirmation.
 

10.4 We have the right to deduct all costs incurred from any potential refund.
 

11. Service providers

 

11.1 Our website is hosted on Wix.com

12. Governing Law and Jurisdiction

​

12.1 The Contract (including any non-contractual matters) is governed by the laws of England and Wales.
 

12.2 Disputes can be submitted to the jurisdiction of the courts of England and Wales.
